  1. Introduction. <\/strong>Accolade IP (M) Sdn. Bhd. (“Accolade”, “we”, “us”, or “our”) is committed to protecting and respecting your privacy. We comply with the Personal Data Protection Act 2010 and the Personal Data Protection (Amendment) Act of 2004 of Malaysia (collectively referred to as “PDPA”) and, where applicable, international privacy laws. This Privacy Policy explains how we, in our capacity as a Data Controller (as defined below), collect, use, process, and disclose your Personal Data when you access our website, use our services, or interact with us.<\/li>\n<\/ol>\n

    By visiting our website or using our services, you accept and consent to the practices described in this policy.<\/p>\n

    1. Definitions<\/strong><\/li>\n<\/ol>\n

      • “Personal Data”<\/strong>\u00a0means any information in respect of commercial transactions, which is being processed wholly or partly by means of equipment operating automatically, that relates directly or indirectly to a Data Subject, who is identified or identifiable from that information.<\/li>\n

      • “Services”<\/strong>\u00a0means the intellectual property services provided by Accolade IP (M) Sdn. Bhd., including trademark registration, trademark search and watch services, design registration, and related IP support services in Malaysia and overseas jurisdictions.<\/li>\n
      • “Data Subject”<\/strong>\u00a0means the individual who is the subject of the Personal Data.<\/li>\n<\/ul>\n

        1. Collection of Personal Data. <\/strong>We may collect and process the following data about you:<\/li>\n<\/ol>\n

          • Information you give us:<\/strong>\u00a0You may give us information about you by filling in forms on our site (www.accoladeip.com\/my), by corresponding with us by phone, email, or otherwise, or by engaging us for Services. This includes information you provide when you chat with us thru our site, subscribe to our service packages, or report a problem with our site.\u00a0The information you give us may include your name, address, email address, phone number, passport number, NRIC number, any other identification card, and financial information. Unless specifically required for a Service, we do not collect Sensitive Personal Data (including physical or mental health, political opinions, religious beliefs).             1. Purpose of Processing. <\/strong>As the Data Controller, we determine the purposes for which your Personal Data is processed. We use information held about you in the following ways:<\/li>\n<\/ol>\n

              • To provide our Services:<\/strong>\u00a0To carry out our obligations arising from any contracts entered into between you and us, such as registration of Trademarks.<\/li>\n<\/ul>\n

                • Conflict Checks and Due Diligence:<\/strong> To conduct conflict of interest checks and internal due diligence as required by our risk management policies, including screening against international sanctions lists and verifying client identity to prevent financial crime.<\/li>\n<\/ul>\n

                  • Communication:<\/strong>\u00a0To provide you with information, products, and services that you request from us, or which we feel may interest you, where you have consented to be contacted for such purposes.<\/li>\n
                  • Site Improvement:<\/strong>\u00a0To ensure that content from our site is presented in the most effective manner for you and for your computer.<\/li>\n
                  • Security:<\/strong>\u00a0To protect our platforms and services from fraud and unauthorized access.<\/li>\n<\/ul>\n

                    1. Sharing Information Outside of Accolade.<\/strong> We may share your Personal Data with third parties. Where these third parties process data on our behalf, they act as data processors. We require all Data Processors to comply with the Security Principle as mandated by the PDPA (Amendment) Act 2024.:<\/li>\n<\/ol>\n

                      • Affiliates:<\/strong>\u00a0Any member of our group, which means our affiliates, subsidiaries, our ultimate holding company and its subsidiaries, including our offices in Singapore, Hong Kong, Mainland China, Philippines, Macau, and Taiwan.<\/li>\n
                      • Strategic Partners:<\/strong>\u00a0Selected third parties including business partners, suppliers, and sub-contractors for the performance of any contract we enter into with them or you (e.g., courier services, cloud hosting providers).<\/li>\n
                      • Regulatory Authorities:<\/strong> The Intellectual Property Corporation of Malaysia (MyIPO) and other competent authorities where we are under a duty to disclose data to comply with any legal obligation.<\/li>\n
                      • Professional Advisors:<\/strong>\u00a0Our auditors, insurers, external legal advisors, and bankers, but only to the extent necessary for them to provide their professional services to Accolade (e.g., for internal and financial audits, insurance claims, or banking compliance).<\/li>\n
                      • International Transfers:<\/strong> Where we transfer your Personal Data outside of Malaysia (e.g., to our headquarters in Hong Kong or cloud servers overseas), we will ensure that the recipient is located in a place that has in force a law which is substantially similar to the PDPA, or that ensures an adequate level of protection in relation to the processing of personal data that is at least equivalent to the protection under the PDPA.<\/li>\n<\/ul>\n

                        1. Consent<\/strong>. By providing your Personal Data to us, you consent to the collection, use, and disclosure of that data as set out in this Privacy Policy.<\/li>\n<\/ol>\n

                          • Direct Marketing:<\/strong>\u00a0We will strictly adhere to the requirements of the PDPA regarding direct marketing (e.g., newsletters about IP law changes, trademark maintenance and renewal deadlines). If you wish to opt-out of receiving marketing communications, you may do so at any time by contacting us.<\/li>\n
                          • Withdrawal of Consent:<\/strong>\u00a0You may withdraw your consent for the collection, use, or disclosure of your personal data at any time by giving written notice to our Data Protection Officer. Please note that if you withdraw your consent, we may not be able to continue providing you with our Services.<\/li>\n<\/ul>\n

                            1. Disclosure of Personal Data.<\/strong>We strictly limit the disclosure of your Personal Data. We do not sell, trade, or otherwise transfer your Personal Data to outside parties for their independent marketing purposes. Disclosures are strictly limited to those necessary for the provision of our Services or compliance with the law.<\/li>\n
                            2. Security of Personal Data.<\/strong>We use a variety of security technologies and procedures to help protect your personal data from unauthorized access, use, or disclosure.<\/li>\n<\/ol>\n

                              • Data Breach Notification:<\/strong> In the event of a personal data breach which causes or is likely to cause significant harm to you, we will notify the Personal Data Protection Commissioner within 72 hours of becoming aware of the breach, and will notify you without unnecessary delay, as required by the PDPA (Amendment) Act 2024.<\/li>\n
                              • Physical Security:<\/strong>\u00a0We maintain strict physical control over our offices and storage facilities where files held for the clients, if any, are temporarily held.<\/li>\n
                              • Digital Security:<\/strong>\u00a0All electronic data is stored on secure servers with firewall protection and encryption protocols. Payment transactions are encrypted using SSL technology.<\/li>\n
                              • Access Control:<\/strong>\u00a0Access to your Personal Data is restricted to those employees, agents, contractors, and other third parties who have a business need to know.<\/li>\n<\/ul>\n

                                1. Retention of Personal Data.<\/strong>We will only retain your Personal Data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Data provided for unsuccessful service applications will be destroyed within a reasonable timeframe unless you consent to its retention for future opportunities.<\/li>\n
                                2. Your Rights.<\/strong>Under the PDPA, you have the right to:<\/li>\n<\/ol>\n

                                  • Check whether we hold Personal Data about you and to access such data (Access Request).<\/li>\n
                                  • Require us to correct any Personal Data relating to you which is inaccurate, incomplete, misleading, or outdated (Correction Request).<\/li>\n
                                  • Withdraw your consent to the processing of your Personal Data.<\/li>\n
                                  • Prevent processing for purposes of direct marketing.<\/li>\n
                                  • Ascertain our policies and practices in relation to Personal Data.<\/li>\n<\/ul>\n

                                    To exercise these rights, please contact our Data Protection Officer. We may charge a reasonable fee for the processing of any data access request.<\/p>\n

                                    1. Language.<\/strong> In accordance with Section 7(3) of the PDPA, this Privacy Policy is issued in both English and Bahasa Malaysia. In the event of any inconsistency between the English version and the Bahasa Malaysia version, the English version shall prevail.<\/li>\n
